These Terms of Service (hereinafter referred to as "TOS", or "Terms"), are applicable at all times throughout, the use of our service and website (https://navy-blue.com),("Website"), provided by NAVY BLUE P.C. (hereinafter referred to as "Navy Blue", "We", "Us", "Our", or, "Service"). Our Service provide you with daily private and semi-private boat cruises around the picturesque islands of Greece. If you haven`t read these Terms in detail, we strongly advise you to do so before using any of our Services. If you do not agree with Our TOS, you should avoid/stop using any of the Services provided by Us. Any use of the Services mirrors your acceptance and bounding to these Terms.

1. Booking Policy
1.1 Booking Procedures

  • Cruises can be booked through our website, by phone, or in person;

  • For all type of cruises, payment is required at the time of booking;

  • All payments must be made in the local currency, which is the Euro (EUR). The amount charged to a client’s credit card will be based on the conversion of the price from Euros to the clients local currency, using the exchange rate determined by the clients credit card association at the time of the transaction;

  • Mandatory Identification details (name, surname, ID number, birth date, nationality) are required on the day of the booking. It is the responsibility of the Client to be in possession of a valid identification document (ID, Passport, Drivers Licence, Residence Permit) for the duration of the tour;

1.2 Itinerary Flexibility

  • The itinerary for each cruise is subject to change based on weather conditions to ensure the safety and enhance the experience of our passengers;

  • In the event of an itinerary adjustment, passengers will be informed in advance about the new route and any changes to the schedule;

2. Cancellation
2.1 Cancellation by the customer

  • For Semi-Private cruises, full refund is provided for cancellations up to 48 hours before departure and half refund is provided for cancellations up to 24 hours before departure;

  • For Private cruises, full refund is provided for cancellations up to 14 days before departure, and half refund is provided for cancellations up to 7 days before departure;

  • For non-show cancellations, no refund is issued;

2.2 Cancellation by Navy Blue

We reserve the right to cancel any cruise due to bad weather, technical issues, or other unforeseen circumstances. In such cases, customers will be offered a full refund or the option to reschedule.

2.3 Refunds and Rescheduling

Refunds will be processed within 10 business days of the cancellation and will be returned via the original method of payment. Instead of a refund, passengers may choose to reschedule their cruise to another date at no additional cost, subject to availability.

3. Safety and Conduct
3.1 Safety Protocols

Passengers must adhere to all safety instructions and regulations provided by NAVY BLUE P.C. before and during the cruise. This includes, but is not limited to, wearing life jackets when required, remaining seated during navigation unless otherwise instructed, and following the crew instructions during emergencies.

3.2 Conduct Aboard the Vessel

Passengers are expected to behave in a manner that respects the safety and comfort of others. Prohibited behaviors include, but are not limited to, excessive noise, harassment of any kind, and the use of illegal substances. The captain or designated crew member has the right to take necessary action, including disembarking passengers, should their conduct be deemed inappropriate or dangerous.

3.3 Alcohol and Substance Policy

Consumption of alcohol is permitted in moderation. Passengers must not consume alcohol brought onboard themselves; only alcohol offered by the onboard service may be consumed. Illegal drugs or controlled substances of any kind are strictly prohibited on all cruises.

3.4 Responsibility for Minors

Adults accompanying minors are responsible for their behavior and safety throughout the cruise. Minors must be supervised at all times to ensure their actions do not compromise their safety or the safety of others.

3.5 Compliance with Crew Instructions

For the safety of all onboard, passengers must comply with all instructions from the crew. Failure to comply with safety instructions or interference with the crew’s duties is taken seriously and may result in removal from the vessel.

3.6 Liability for Damage

Passengers will be held responsible for any damage they cause to the vessel or its furnishings as a result of negligent or intentional acts. A fee may be charged to cover the cost of repairs or cleaning.

3.7 Loss of Personal Items

Navy Blue is not responsible for the loss, damage, or theft of personal items brought aboard by passengers. Passengers are encouraged to keep valuable items with them at all times and use caution when bringing personal belongings on board. We recommend leaving highly valuable items at home or securely storing them during the cruise. If a loss is discovered, passengers should immediately report it to the crew, who will assist in any way possible within the limitations of our policies.

4. Liability
4.1 Limitation of Liability

Navy Blue shall not be liable for any injuries, losses, damages, or expenses suffered by passengers that are attributable to the actions or omissions of the passengers, or to natural occurrences, acts of God, or other factors beyond our control. This limitation of liability shall apply to all types of claims, including injury, accident, death, delay, inconvenience, loss of enjoyment, etc., regardless of the cause or origin.

4.2 Passenger Responsibility

Passengers are responsible for their own safety and should act prudently and sensibly at all times to avoid accidents on board and during embarkation and disembarkation. Passengers must comply with all safety instructions and guidelines provided by the crew and must use safety equipment provided. Passengers should inform the crew immediately if they observe any unsafe conditions or behaviors.

4.3 Assumption of Risk

By participating in a cruise with Navy Blue, passengers acknowledge and accept the inherent risks associated with such activities, including but not limited to injuries from slipping on wet surfaces, the motion of the vessel, and incidental contact with marine life. Passengers agree that they are voluntarily participating in these activities and assume all risk of injury, illness, damage, or loss that might result.

4.4 Indemnification

Passengers agree to indemnify and hold harmless Navy Blue, its employees, agents, and representatives from any claims, liabilities, losses, damages, or expenses, including reasonable attorneys’ fees, arising from their breach of these Terms, their negligence, or other acts or omissions while using Navy Blue’s services.

5. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Greece, and any laws applicable therein.

By using our Services, You express your unconditional consent and irrevocably agree that any suit, action, or proceeding, arising out of the Terms or your use of our Service, that may be pursued by You will proceed to the courts of Greece, except for all disputes subject to arbitration.

Navy Blue and You, agree to arbitrate any dispute arising from these Terms or your use of our Service, with the exception of disputes arising out of infringements of registered or unregistered trademarks, copyrights, trade names, logos, or patents, in which either party may be seeking any type of relief.

You agree that you will take action and serious efforts in the direction of an informal resolution by contacting us directly and explaining the source of the dispute. Navy Blue will take the necessary course of action to resolve any type of dispute if possible. If no satisfying resolution is achieved regarding the matter, the dispute shall be resolved through arbitration conducted in confidentiality and the number of arbitrators shall be only one.

Navy Blue and You, agree to not participate in a class action or class-wide arbitration for any claims included in these Terms.

6. Terms of Service Modifications

These terms may be subject to updates and modifications. Navy Blue is not going to notify you about the modifications of these Terms. By using our Services, you agree to the last updated version of these terms. Therefore, we strongly recommend you to regularly check our terms so you can spot any modifications and make sure you agree to be bound to them. If you do not agree with any modification to these terms, you should stop using our Services.
